Terms of Sale (AGB)

1. Seller and scope
These terms apply to all orders placed on kafkefstudio.com. The seller is Serdar Bulut, sole trader, trading as KAF KEF Studio (Kafkef Studio), Spengergasse 38/12, 1050 Wien, Austria, email hello@kafkefstudio.com, phone +43 660 3988505, VAT ID ATU83749026 (further details in our Impressum). Deviating terms of the customer do not apply. The contract languages are English and German.
2. Conclusion of the contract
Products shown in the shop are not a binding offer but an invitation to order. By clicking the order button at checkout you place a binding order. You will receive an automatic email confirming receipt of your order; this is not yet an acceptance. The contract is concluded when we confirm shipment by email or dispatch the goods. For "Create your own" pieces the contract is concluded when we confirm your design by email. We save the contract text; you receive the order details by email.
3. Prices and shipping costs
All prices are in euros and include statutory VAT. Shipping costs are shown before you complete your order at checkout. Customs duties and import taxes for deliveries outside the EU may apply and are borne by the customer.
4. Payment
You can pay using the payment methods offered at checkout. Payment is due when you place your order. Payments are processed by our payment providers; we do not store your card details.
5. Delivery
We ship to the countries listed at checkout. Orders usually leave our Vienna studio within 1–2 business days; "Create your own" pieces are made to order and ship within the time stated on the product page or in our confirmation. Delivery times are estimates. If an item is unexpectedly unavailable, we will inform you immediately and refund any payment already made. For consumers, the risk passes when the goods are handed to you.
6. Retention of title
Goods remain our property until paid in full.
7. Right of withdrawal and returns
Consumers have a statutory 14-day right of withdrawal. Details, the exclusion for personalised "Create your own" pieces, our voluntary 30-day return window and the model withdrawal form are set out in our Refund policy.
8. Handmade and personalised pieces
Our pieces are hand-finished and partly made from upcycled or reclaimed textiles. Small differences in colour, pattern, placement and measurements compared with product photos are a natural part of the product and not a defect. For "Create your own" orders you are responsible for ensuring that any content, names, images or designs you supply do not infringe third-party rights; we may refuse designs that are unlawful or offensive.
9. Warranty
Statutory warranty rights (Gewährleistung) apply. Please report visible transport damage to us as soon as possible so we can claim it from the carrier; this does not affect your statutory rights.
10. Liability
We are liable without limitation for intent and gross negligence and for personal injury. For slight negligence we are liable only for breach of essential contractual obligations and limited to the typical, foreseeable damage. Liability under the Product Liability Act (PHG) and mandatory consumer protection rules remain unaffected.
11. Discount codes
Discount codes are valid only within their stated period, cannot be combined unless stated otherwise, cannot be exchanged for cash and are limited to one per order. The welcome code is valid once, on your first order.
12. Applicable law and jurisdiction
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law does not remove the protection of mandatory provisions of the law of the country in which they habitually reside. For consumers resident in Austria, the court at their place of residence, habitual residence or employment has jurisdiction.

14. Final provisions
If any provision of these terms is invalid, the remaining provisions remain effective.
